Many employers assume that the trade union reforms expected in October 2026, under the Employment Rights Act 2025, will have little relevance to their organisation because they do not currently recognise a union or have any union members (as far as they are aware…). However, the reforms are intended to strengthen trade union rights and make it easier for unions to engage with workers in a much wider range of workplaces - regardless of size or sector.

At the same time, employers already face numerous consultation and employee engagement obligations that are often overlooked until a problem arises. From redundancy exercises and TUPE transfers to the allocation of tips and wider workplace change, managers are increasingly expected to understand when consultation and engagement is required and how to approach it effectively.
